Phone calls aren’t a public meeting

If county commissioners want to pitch their voters on a property tax increase, the commission publicly vote to say so, a judge has found after Camden County’s commission skipped the step last year.  

Commissioners Cody Smith and James Goodman complained to the Superior Court of Camden County late last year because their county announced in a Sept. 18 legal ad in the Tribune & Georgian that Camden commissioners had “adopted” a proposal for a higher millage rate, and invited the public to three subsequent public hearings.

The two commissioners argued that “adopting” a proposal means holding a vote in public, per the state’s Open Meeting Act, not the phone calls or briefings that commission Chair Ben Casey or the county administrator made to commissioners seeking a consensus.

The legal complaint didn’t halt the tax-setting process — which finished last year without a millage rate increase.

But the ruling clarified the commissioners’ legal question; and in his order last week, Superior Court Judge Anthony L. Harrison indicated why open meetings are important.

Georgia’s Open Meetings Act “was enacted in the public interest to protect the public — both individuals and the public generally — from ‘closed door’ politics and the potential abuse of individuals and the misuse of per such policies entail,” he wrote.
